Dept. of Labor finds labor violations at Carniceria Guanajuato

Department of Labor investigators determined three Indianapolis-based Mexican grocery stores and restaurants owe 104 employees nearly $45,000 in unpaid wages.

Carniceria Guanajuato, known for their great customer service and smiling workers, failed to pay their workers the minimum wage and for overtime worked. The total debt adds up to $44,936.

This is the second time in three years that the grocery store has come under investigation. The Department of Labor investigators were tipped off this time when the company took deductions for uniforms from employees pay that put their wages under the minimum wage.

“This investigation is a win for workers. These entry-level workers, often with limited English proficiency, are particularly vulnerable to unfair labor practices,” said Karen Chaikin, regional administrator for the Wage and Hour Division in Chicago. “The Wage and Hour Division will use every tool it has to get workers the wages they earned and level the playing field for employers”.

The company agreed to pay workers back the money owed for compliance with the Fair Labor Standards Act. They also were assessed civil penalties of $22,800 for violations of the FLSA and agreed to a set of rules to remain in compliance. These rules include annual audits, providing all employees with pay stubs, and training managers to monitor employee clock in/out times.
